Terms for Participants on MITRA
Deutsche Fassung: Buchungsbedingungen. The English and German versions are equally binding; if they differ, the version more favourable to you applies.
These Booking Terms govern how you book and pay for Activities on MITRA. Host-side rules are in the Host Terms. EU-level law is cited inline; German statutes are pinned in the Country Annex (Part B) next to the clause they support.
Definitions
- MITRA / we / us — RS Community App UG (haftungsbeschränkt), operator of the MITRA app and website and of the booking-intermediation and payment-collection service.
- You / Participant — a person who books a place at an Activity through MITRA.
- Host — the person who creates, organises, and runs the Activity. Host-side rules are in the Host Terms.
- Activity — a 1-on-1, group, or public real-life activity offered by a Host. A Paid Activity has a Ticket price.
- Ticket price — the amount the Host charges for a place; set by the Host, VAT included where the Host owes VAT.
- Price — what you pay: the Ticket price × the number of places you book. MITRA adds no booking fee or other charge on top.
- Card fee — the payment-processing fee Stripe charges for your payment. It is paid out of the Ticket price, not added to it, and matters to you only if you cancel yourself (§A3, §A4).
A1. Who you are contracting with
1.1 MITRA is the platform and the payment collector — the Host is the organiser. When you book a Paid Activity, you enter a contract for the Activity directly with the Host, who alone organises and delivers it. MITRA is not the organiser, is not your counterparty for the Activity, and is not responsible for how the Activity turns out. (Platform/marketplace status: DSA, Regulation (EU) 2022/2065; marketplace information duties per the Country Annex.)
1.2 Your contract with MITRA is limited to (a) use of the platform and (b) MITRA’s booking-intermediation and payment-collection service. MITRA charges you nothing for this service; MITRA is paid by the Host, out of the Ticket price (see Host Terms §A5). MITRA collects your payment, holds it, and pays the Host after the event (see Host Terms §A6).
1.3 Trader or private Host — and what it means for you. Before you book, MITRA shows you whether the Host acts as a trader or as a private individual, based on the Host’s declaration. If the Host is a private individual, the consumer-protection rules that apply to trader-to-consumer contracts do not apply to your contract with that Host. Your consumer rights against MITRA (a trader) for the booking service are unaffected. (Marketplace trader-transparency duty — see Country Annex.)
A2. What you pay — the Ticket price, nothing added
2.1 Before you commit, MITRA shows you the price you will pay — the Ticket price multiplied by the number of places you book — inclusive of any applicable VAT. MITRA adds no booking fee, service fee or other charge on top: the price shown is the price you pay. (Total-price display: origin in the Consumer Rights Directive 2011/83/EU and price-indication rules; German basis in Annex B-DE.)
2.2 The paid-order button. The button you press to complete a paid booking names the payment and the amount — in the app it reads, for example, “Pay €12.00” (German: “12,00 € bezahlen”). You then complete the payment on Stripe’s secure payment page. Pressing the button obliges you to pay the amount shown. (German basis: § 312j Abs. 2–4 BGB — see Annex B-DE.)
2.3 Payment is processed by Stripe. You may be asked to complete bank/card authentication (strong customer authentication).
2.4 Equal access across the EEA. MITRA does not block your access, or refuse your booking or payment, because of your nationality or country of residence within the EEA, and does not discriminate against a means of payment it accepts because of the country of your payment account. MITRA may still choose which payment methods it offers and may require standard payment authentication. (EU basis: Geo-Blocking Regulation (EU) 2018/302, esp. Art. 4–5.)
A3. No booking fee — and the card fee if you cancel yourself
3.1 MITRA charges you no booking fee. MITRA’s own fee and the card fee for your payment are paid by the Host, out of the Ticket price.
3.2 The card fee. Stripe charges a payment-processing fee on every card payment and does not return it when a payment is refunded. The amount depends on your card: for standard EEA cards it is currently 1.5% of the amount + €0.25; premium, UK and non-EEA cards cost more.
3.3 Who carries the card fee on a refund. If you cancel yourself in time (§A4), the card fee Stripe actually charged for your payment is deducted from your refund: you get the Ticket price back minus that card fee. Before you book, MITRA shows you the amount you would get back; until Stripe reports the exact card fee, that amount is shown as an estimate (“about”). In every other refund case — the Host cancels, the Host removes you, MITRA cancels or suspends the Activity, your payment arrives after the last place was sold, or your report is upheld — you get back everything you paid and MITRA carries the card fee.
A4. Refunds and cancellations — the full matrix
Your outcome depends on who cancels and when. This matrix is exhaustive for standard bookings:
| Situation | What you get back |
|---|---|
| Host cancels the Activity (or fails to deliver it) — also if you had already cancelled less than 48 hours before the start | Everything you paid |
| Host removes you from your booking | Everything you paid |
| Your payment arrives after the last place was sold | Everything you paid |
| MITRA cancels or suspends the Activity | Everything you paid |
| You cancel ≥ 48 hours before start | The Ticket price minus the card fee for your payment (§A3.3) |
| You cancel ≥ 48 hours before start, and the app did not show you the card-fee rule before you paid | Everything you paid |
| You cancel < 48 hours before start | Nothing |
| You don’t show up | Nothing |
| You report a problem within 48 h after the event (§A6) | Everything you paid, from held funds, if your report is upheld after review |
4.1 Refunds are made to your original payment method via Stripe. Processing time depends on your bank.
4.2 This matrix sets MITRA’s platform-level handling of the money it holds. It does not cut down any additional mandatory right you may have against the Host under the law of your country if the Host is a trader (e.g., for a defective or non-performed service); those you may pursue against the Host directly.
4.3 Reserved place — and your right to prove a lower loss. When you cancel less than 48 hours before the start and the Ticket price is retained, that reflects the place the Host reserved and held for you; it is not a penalty. Where the retained amount would be treated as lump-sum compensation, you may show that the Host saved expenses or suffered no or a lower loss, and the retained amount is then reduced accordingly. MITRA assesses such a request against the funds it holds. (German basis: § 309 Nr. 5 BGB, and the saved-expenses principle in § 648 S. 2 BGB — see Annex B-DE.)
A5. No 14-day “cooling-off” cancellation right for dated activities
5.1 A distance contract for leisure-activity services tied to a specific date or period has no 14-day withdrawal (“cooling-off”) right. Because every Paid Activity is booked for a specific date/time, you do not have a 14-day right to withdraw from the Activity booking. (EU basis: Consumer Rights Directive 2011/83/EU, Art. 16(l); German basis: § 312g Abs. 2 Nr. 9 BGB — see Annex B-DE.) Your rights under the refund matrix in §A4 still apply.
5.2 What the app shows you. Before you pay, the app tells you: “No right of withdrawal: This is a dated activity, so the 14-day EU withdrawal right does not apply. The cancellation policy above is what protects you.” (German: “Kein Widerrufsrecht: Das ist eine terminierte Aktivität, deshalb gilt das 14-tägige EU-Widerrufsrecht nicht. Dich schützt die Stornoregel oben.”)
5.3 MITRA’s booking service is free for you. MITRA charges you nothing for its booking-intermediation and payment-collection service (§A1.2).
A6. Report a problem within 48 hours
6.1 If the Activity did not take place, or materially differed from how it was described, you can report it through the app within 48 hours after the scheduled end.
6.2 On a timely report, MITRA may place or extend a hold on the Host’s payout and, after a fair review, refund you from the held funds where your report is upheld. This is how MITRA administers the money it is still holding; MITRA does not thereby become the organiser or the judge of the Activity’s merits, and its review is without prejudice to any claim you have directly against the Host.
6.3 Reporting is not a substitute for your safety. If something is unsafe or unlawful, contact the Host, venue security, or the authorities as appropriate.
A7. Safety, conduct, and attending at your own risk
7.1 You attend Activities at your own risk. Activities are organised and run by Hosts and take place in the real world, among people you may not know. MITRA does not vet, supervise, chaperone, or guarantee Hosts, Participants, venues, or Activities, and is not responsible for the conduct of Hosts or other Participants, for the venue, or for what happens at an Activity. Use your judgement; meet safely.
7.2 Safety tools. MITRA offers safety features, including the option to share an Activity’s details (location, time, participants) with a trusted contact, and tools to block and report users. Use them. Report unsafe or abusive behaviour to MITRA and, where needed, to the authorities.
7.3 MITRA’s liability. MITRA excludes liability for the Activities and for anything that happens at them, to the fullest extent the applicable law allows. MITRA does not exclude liability that cannot be excluded by law — including for intent and gross negligence, for injury to life, body, or health, and under any applicable non-excludable regime. The precise, enforceable limitation wording is set in the Country Annex (in Germany, policed by AGB control). Your mandatory consumer rights and your rights against the Host are unaffected.
7.4 Eligibility. You must be at least 18 to book. Activities are for real-life social connection; MITRA is not a dating or adult-services platform.
7.5 Reviews. After an Activity ends, Participants who booked it may leave qualitative feedback. Only a Participant who booked the Activity and whose Activity has ended can review it — this is how MITRA ensures reviews come from people who actually took part, and MITRA states this verification method wherever reviews are shown. MITRA does not publish fake, purchased, or incentivised reviews and may remove reviews that are unlawful, abusive, or fabricated. (German basis: § 5b Abs. 3 UWG — see Annex B-DE.)
A8. Data protection (GDPR)
8.1 MITRA processes your personal data to run the platform and your bookings — account and profile data, booking and payment-facilitation data, safety and support data. Legal bases include performance of your contract with MITRA (GDPR Art. 6(1)(b)), MITRA’s legitimate interests in operating and securing the service (Art. 6(1)(f)), your consent where asked (Art. 6(1)(a)), and compliance with legal obligations (Art. 6(1)(c)). Full detail is in the MITRA Privacy Policy.
8.2 Sharing. To fulfil a booking, necessary data is shared with the Host (who is an independent controller for the data it needs to run its Activity and must use it only for that) and with Stripe for payment. MITRA does not sell your personal data.
8.3 Payments. Card/bank data is handled by Stripe under its own terms; MITRA does not store full card numbers.
8.4 Your rights. You have the GDPR rights of access, rectification, erasure, restriction, portability, and objection, and the right to complain to a supervisory authority. Exercise them via the contact in the Privacy Policy.
8.5 Retention that survives account deletion. If you delete your account or ask for erasure, MITRA deletes or anonymises your data except where it must keep specific records to meet statutory retention duties — in particular payment, invoicing, and accounting records that tax and commercial law require it to retain. Those records are kept, access-restricted, for the legally required period and then deleted. This statutory duty overrides the erasure right for those records (GDPR Art. 17(3)(b)). The exact periods are in Annex B-DE.
A9. Changes to these terms
9.1 MITRA may update these Booking Terms. Material changes are notified to you (in-app or by email) before they take effect. Changes do not alter the terms of a booking you already made; each booking is governed by the version in force when you made it. (Transparency: DSA Art. 14.)
9.2 Bookings created under the earlier fee model (with a Booking Fee) keep that model’s figures and rules, including the Booking Fee they paid and its refund rule (Ticket price refunded, Booking Fee kept, on a timely cancellation).
9.3 Earlier versions. Every version stays readable at its own address: 2026-10-02 · 2026-10-01.
A10. Governing law, jurisdiction, and consumer dispute resolution
10.1 Governing law and competent courts are set in the applicable Country Annex (Part B). This choice never deprives you, as an EEA-resident consumer, of the mandatory protections of your home country (Rome I, Regulation (EU) 593/2008, Art. 6). As an EEA-resident consumer, you may bring proceedings in the courts of your own country of domicile, and may be sued only there (Brussels Ia, Regulation (EU) 1215/2012, Art. 17–19).
10.2 Consumer dispute resolution. MITRA is not obliged to, and does not, participate in dispute-resolution proceedings before a consumer conciliation board (Verbraucherschlichtungsstelle). (§§ 36, 37 VSBG.)
10.3 Form of your notices. Any notice, cancellation, or declaration you give MITRA may be made in text form (Textform — e.g. in-app or by email); MITRA does not require any stricter form from you. (German basis: § 309 Nr. 13, § 126b BGB.)
Annex B-DE — Germany (in force)
Governing law: German law, excluding the CISG. Mandatory German consumer protections apply to consumers habitually resident in Germany; for consumers resident elsewhere in the EEA, Rome I Art. 6 preserves their home protections.
Competent courts: Statutory rules. A consumer may sue and (subject to Brussels Ia) generally be sued at their own domicile; no place-of-jurisdiction clause is imposed on consumers.
Contract languages: German and English. Both versions are equally binding; if they differ, the version more favourable to you applies.
Withdrawal-right basis: § 312g Abs. 2 Nr. 9 BGB — no right of withdrawal for “Verträge zur Erbringung von Dienstleistungen … im Zusammenhang mit Freizeitbetätigungen, wenn der Vertrag für die Erbringung einen spezifischen Termin oder Zeitraum vorsieht.” Every dated Activity falls within this exception (§A5.1). MITRA’s own booking service is free of charge for you (§A5.3).
